Yeh, serious bidders only --on an auction where I can't even get the book title right! The Hobbit/LotRs --same difference...

Hi Red,

Good question - though the estate would have to come down on the seller, not Saul & co - the astute follower will have noticed that they have even removed Tolkien from their own business name (Middle-earth Enterprises, used to be Tolkien Enterprises). http://www.middleearth.com/about.html

In wrangling with the Estate over the years, it is clear that they do not have rights to anything "Tolkien".

The Estate are not going after people using Shire in their name but Enterprises (Saul & Co) are, FITS look out.

Nearly everyone in England, Scotland, and Wales have lived in an area called a shire for at least 1000 years

And there you have it - the word "Tolkien" does not appear in those two books, much to their chagrin. (They used "Tolkien Enterprises" and "Tolkien Quest" books, and... for years, until they got in trouble over it).

Yeh, the trouble is everything Middle-earth Enterprises license is, as they state, based on "Tolkien works" --& they own "exclusive worldwide rights to motion picture, merchandising, stage and other rights in certain literary works of J.R.R. Tolkien including The Lord of the Rings and The Hobbit." Making them remove "Tolkien" from their name is total pedantry, in the grand scheme of things (--if that's what happened). Peter Jackson's films aren't based on any old Lord of the Rings and any old Hobbit --they're based on J. R. R. Tolkien's The Lord of the Rings and The Hobbit. Whether The Tolkien Estate like this connection, or not, is immaterial --the connection exists.
