I’m a Tolkien collector living in the United States, and this is a disappointing situation.
I just ordered from Folio Society a few weeks ago, and that shipment got here with no problems. I wish Harper Collins could figure out how to do the same.

While it is of course a disappointment, it should be noted that this situation is in many respects still a fluid one. When Paul Corfield Godfrey's musical chapters from The Lord of the Rings was released in early September we found ourselves in a difficult position with regard to US orders. We were hit with export charges and it appeared that those charges would in fact be held back. In reality they were not actioned and we were able to reflect that for those in the US who had ordered, but the information was and still is somewhat opaque. Books/CDS/posters were specifically said to be excluded from charges yet we were faced with them regardless and until the charges held were released, we had no idea what was happening. HarperCollins are most likely facing similar issues and have to act accordingly.
This situation was not created by HarperCollins after all and they can only respond to what is in front of them.
It's of course HC's own decision, it is not a crime to ship to the US. It's a business decision, why ship to the US when you can likely make more profit shipping elsewhere? Although hard to believe selling 1000 books at any reasonable price is a substantial chunk of profits for a company their size.
I don't know UK business law but in the US at least, I believe if you are a publicly traded company (HC is a division of NewsCorp, $NWSA) then you have a legal obligation to endeavor to maximize value for shareholders.
HC could of course change their mind but I'd imagine at that point these 1000 copies will be sold out. Maybe they will make more.

There are always options if a dealer/retail won't ship to your country and you really want the item. Plenty of forwarding services out there that will receive your order in that country and then ship to you for a fee. "Forwardtome" comes to mind, but there are many others.

This product will be sold on a first come, first served basis once the 'On sale' notification has been released to our dedicated mailing list at 1pm (GMT) on Wednesday 5th November
