That was pretty one-sided against Polychron, let's see what happens with the Tolkien Estate vs Polychron copyright infringement case.

[Plaintiff] has bodily appropriated the [Lord of the Rings] characters in his [novel]. This Court need not determine whether the characters in [Plaintiff's work] are substantially similar to [Defendants'] characters, as it is uncontroverted that the characters were lifted lock, stock and barrel from [The Lord of the Rings].

DP's letters are cited. I knew those would come back to bite him.

15 pages and at least half of that are his barmy letters. I hope he calls time on this before it costs him his house, if not already.

It is a bit late for that, they have asked for him to pay the lawyer's fees for the Estate and Amazon, plus he is now facing a copyright infringement case, which he appears to have admitted to in these letters, with the Tolkien Estate.

He has essentially convicted himself through his own letters. I feel for him in many respects as his worldview appears so skewed and I wouldn't want anyone to suffer financial harm where it can be avoided. Of course this is all his own doing, yet it is his family who will ultimately suffer while he will continue to believe that he has been shafted.

This guy should do what every other fanfiction writer is doing, publishing on AO3 for no profit, and then opening a patreon and have people donate to him. There are fanfiction writers making $50,000 a month doing this. Just saying. I have no idea the legality of such things. Also, I just want to add I'm against doing that as well. I don't know why people are allowed to do such things.

The Tolkien Estate has published their position: https://www.tolkienestate.com/frequently-asked-questions-and-links/

AO3 position fan fiction as fair use as transformative and non-commercial. Running a patreon violates the non-commercial side of things (in my opinion). Were the Estate to come across a Middle-earth fan fiction author making money on Patreon, I would expect they would take action.
