In select instances, the
Estate has authorized creation of certain derivative and ancillary works for the
purpose of reaching new generations of fans worldwide and helping maintain the
enduring popularity of Professor Tolkien’s original literary works. The Amazon
Series, as a prequel to TLOTR that expands on its largely unexplored appendices, is
one such select derivative.

Is this the first offical statement from the Tolkien Estate as to why they allowed RoP to happen?

If you watch the vid on p3 of this thread loaded by Trotter from 12 minutes it shows how ludicrous these claims are.

The closest similarity imo that I've seen mentioned seems to be that the fanfic includes a flashback of Galadriel traveling to Numenor.

But Amazon's motion explains that the circumstances are a bit different, and amazon also found some case law where a court had ruled that two works sharing the premise of "an American war veteran [who] travels to Japan in the 1870s to train the Imperial Army in modern Western warfare" was not considered enough of a similarity to be protectable. (They don't explicitly tie that case law to the Galadriel in Numenor accusation, but it seems to me that's why they quoted that line.)

DP's possibly legitimate claims are all of the spurious, un-copyrightable nature such as "I wrote that a character had a blindfold on, your show also has a character with a blindfold on".

These claims are of small details, not in sequential order or relating to the structure or plot of the show or his book. If his book had a sequence where orcs dug a trench across the valley and then flooded the volcano by triggering an ancient dam's destruction, that would be significant. But they aren't.

Here's an example spurious claim of his: "I have a character named Elanor who is the daughter of Samwise in my book, and the Amazon show also has a character named Elanor in it!" Spot the glaring problem there?

🤦 I missed that point. Every time I think that this guy has given all he has, he gives a little more.

In some aspects I feel quite sorry for him. I can't imagine someone of sound mind would get themselves into such a tizz, but the lawyers, they really make my blood boil. That they would ever encourage this is tantamount to client abuse in my opinion.

Looks like both Amazon and the Estate are trying to recoup some of their fees, will get nothing from DP but could get some money from his lawyer for allowing such a 'frivolous' lawsuit to be entered.

The PPP video was a really good watch. I think he says what pretty much all Tolkien fans and anyone with common sense think.
I agree that this guy seems to have been egged on BUT if he has written the various letters, perhaps he's so driven and passionate that he's just difficult to say no to and they went along with it despite them advising otherwise.

Tbh, it seems like this man is unwell. His lawyer should have evaluated his claims and never agreed to file the suit. The case is likely to put the author in financial ruin and the lawyer in career jeopardy.
